What should employers do now to prepare?
- Sign up to receive emails from the FAMLI Division at paidleave.maryland.gov - [Register for a FAMLI account](https://paidleave.maryland.gov/register/). After registration, all employers will automatically be enrolled in the State Plan. Employers can alternatively explore private plans. - Identify an Authorized Officer to create the employer profile. - Include contributions in future budget planning and consider whether to cover a portion or all employees' contributions. - Start thinking about how existing benefits may interact with FAMLI. - Begin discussing any payroll/administrative adjustments that may be needed. - Evaluate whether policy and handbook changes may be needed. - Begin talking with employees, so they understand their future FAMLI contributions and benefits.
When can I register as an employer?
Employers will be able to register online at paidleave.maryland.gov in Fall 2026. All employers with at least one employee in Maryland will be required to register.
Do S corporations (S corps) need to register and participate in FAMLI?
If the sole owner of an S corp is the only person employed by the S corp, for the purposes of FAMLI the owner is not considered an employer. Only employers are required to register with FAMLI. Once the self-employed option is launched, self-employed individuals may choose to register themselves in order to contribute to FAMLI and become eligible for benefits. Details regarding this option will be available at a later date.
I have a Login.gov account with my personal email. Can I use that account to register an employer?
We understand that many people will already have Login.gov accounts using their personal email account. This makes sense, since you may use your Login.gov account for many purposes, not just FAMLI. You can log in using your personal account. Then, once you begin the employer registration process, you will be able to update your preferred email address. We will use the preferred email address to contact you about FAMLI-related matters for that employer. Editing this email address will not impact your Login.gov account. During employer registration, you also have the option to list a secondary email address for the employer. This secondary email could be a more generic email your employer uses, as a back-up contact method.
During the registration process every employer must identify an Authorized Officer. Is it possible to use a general email [benefits@companyname.com]? Or does the Authorized Officer have to use their individual email address?
An Authorized Officer will need to use their individual email address to create their secure Login.gov account. This is because system emails contain links with permissions tied directly to the individual user's secure login. Later in the employer registration process, they will have the opportunity to also provide a "Work email address." At that time, they may include a general email address that can receive FAMLI updates related to that employer.

My business is an S Corp. When registering with FAMLI, should I select Stock Corporation?
An S corporation (S corp) is not a distinct legal business structure in Maryland. An S corp is a federal tax designation for corporations. The FAMLI business structure selection should match the business type entered when you registered your business in Maryland. If you are unable to locate your business structure in the drop down menu, or need help identifying which business structure to select you can do one of the following: **A. Complete a public search here: [https://businessexpress.maryland.gov/](https://egov.maryland.gov/BusinessExpress/EntitySearch)** - Type in your Business Name or SDAT Department ID Number and hit "Search" - View the "General Information Tab" - Match the "Business Type" with the FAMLI business structure selection **B. Contact the State Department of Assessments and Taxation** - Email: [sdat.cscc@maryland.gov](mailto:sdat.cscc@maryland.gov) - SDAT Customer Service Contact Center: [410-767-1330](https://dat.maryland.gov/businesses/PublishingImages/SDATGraphic.jpg) **C. Speak with an attorney or other business consultant. **
What is a household employer?
A household employer hires an employee to do household work in or around their private home. The household employer controls the employees' work and how they do it. Common examples of this are nannies, housekeepers, or household managers.
My family employs a nanny. Am I considered an employer?
Yes, an employer is anyone who pays a salary or wage to at least one person. All employers will have to comply by offering FAMLI and by submitting wage and hour reports and remitting contributions to the FAMLI Division.
If an employer has sub-agencies or divisions, will all of those sub-agencies and divisions need to register separately?
When an employer registers with FAMLI, they will enter their federal Employer Identification Number (EIN). All sub-agencies and divisions with that same EIN will therefore be registered. FAMLI will only allow one registration per EIN.
How do I connect my employer profile with my Third-Party Agent (TPA)?
Your TPA must register themselves and indicate they are a TPA. After that, they can use their FAMLI account to send an email invitation to sign a Power of Attorney. The invitation will be valid for 14 days. After the Power of Attorney is signed, the TPA can help with FAMLI tasks like submitting QWHRs, remitting contributions, and responding to claims. Important note: only an Authorized Officer can sign a Power of Attorney.
The Power of Attorney (POA) for my Third-Party Agent (TPA) expired. How do I re-establish it?
To reestablish a POA that has passed the authorization end date, please contact the Third-Party Agent (TPA) to request they send you a new invitation. Once the Authorized Officer (AO) receives the invitation, they can approve the request through their FAMLI account and add an appropriate authorization end date. Alternatively, they can leave that field blank so that it does not expire.
